By accessing or using our websites listed in Appendix A (“Site”) or engaging with any of our services, you acknowledge and agree to comply with these Terms of Use. By using the Site in any manner (automated or otherwise), you agree to be bound by these Terms of Use, our Privacy Policy, our Return Policy, and any other applicable policies. We reserve the right to update or revise these Terms at any time, with changes taking effect immediately upon posting.
BUSINESS PURPOSE ONLY
All funding provided by Sower is exclusively for business-purpose, non-owner-occupied real estate transactions. Our services are not for consumer, personal, or owner-occupied use.
NOT A SETTLEMENT SERVICE PROVIDER
Sower does not offer, coordinate, or provide settlement services as defined by RESPA (12 U.S.C. § 2602(3)), including but not limited to title insurance, escrow services, appraisals, or mortgage brokerage.
INTELLECTUAL PROPERTY RIGHTS
All materials on this Site are owned by us or our licensors and protected under intellectual property law. You are granted a limited, personal, non-commercial license to view and print one copy of individual pages for personal use only. You may not copy, distribute, modify, exploit, or use any content for commercial purposes without explicit permission. Any material you submit to us via the Site or otherwise grants us an irrevocable, royalty-free, worldwide license to use, modify, display, and distribute such content in any format.
LICENSE TO US & WORK FOR HIRE

REFERRAL COMPENSATION COMPLIANCE
Referral fees are paid only in connection with exempt business-purpose transactions. No fees are paid in connection with federally related mortgage loans or settlement services. All third-party participants are responsible for ensuring legal compliance.

LIMITATION OF LIABILITY

ASSIGNMENT
This Agreement may not be assigned by you without our prior written consent. We may assign all rights and obligations to affiliates or subsidiaries.
DISPUTE RESOLUTION (ARBITRATION AGREEMENT)
All disputes shall be resolved through binding arbitration, except for eligible small claims or IP disputes. Before initiating arbitration, parties must first engage in good-faith informal resolution. No class or collective actions are permitted.
GOVERNING LAW
These Terms are governed by the laws of the State of Florida. Arbitration will be conducted in Jacksonville, FL.
SEVERABILITY
If any provision is deemed invalid or unenforceable, the remainder of the Terms will remain in full force.
